This circular is about the initiation of bargaining for a new Area School Principals' Collective Agreement.

This circular does not replace any other .

The action needed is to note the contents of this circular and notify the principal of the notification to initiate bargaining for the above collective agreement.

It is intended for Chairpersons of Boards of Trustees of all state and state integrated area schools.

Introduction

Section 43 of the Employment Relations Act 2000 (the Act) requires that, on receiving a notice of intention to bargain for a collective agreement under the Act, details of that notice are to be drawn to the attention of all employees who come within the coverage of the intended agreement within ten days of receiving that notice.

Notice to Initiate Bargaining for a new Area School Principals’ Collective Agreement

On 4 July 2013 the New Zealand Post Primary Teachers’ Association (PPTA) and the New Zealand Educational Institute Te Riu Roa (NZEI) wrote to the Secretary for Education to formally initiate bargaining for the renewal of the Area School Principals’ Collective Agreement. The current collective agreement expires on 1 September 2013.

The PPTA and NZEI propose that the Agreement entered into by the Secretary for Education, acting under the delegation of the State Services Commissioner, and the PPTA and NZEI is intended to cover principals employed in state and state-integrated area schools, who are or who become members of the PPTA or the NZEI.

Notice of Initiation of Bargaining

Area School Principals

 

On 4 July 2013 the New Zealand Post Primary Teachers’ Association (PPTA) and the New Zealand Educational Institute Te Riu Roa (NZEI) formally notified the Ministry of Education that they intend to seek a collective agreement covering every area school principal who is, or becomes, a member of one of the above unions.

For the purposes of this notice, “employer” means every board of trustees (or commissioner as appropriate) of a state or state integrated area school.

The intended parties to the collective agreement will be the PPTA, the NZEI and the Secretary for Education acting under delegation from the State Service Commissioner issued in accordance with the State Sector Act 1988. The agreement sought will bind all employers and all members of the PPTA or the NZEI coming within the coverage of the proposed collective agreement as outlined above.
